HHS unveils potential civil rights protection language for Obamacare

Ending discrimination against gender identity is a hot topic nationwide, and the health care industry is not exempt.

A proposal to add new civil rights protection language to the Affordable Care Act was announced today by the U.S. Department of Health and Human Services.

The department is seeking public comment on what types of language should be added to protect the civil rights of Americans based on gender identity and language skills.

The new rules would ensure health care providers are compliant in applying non-discriminatory criteria when offering services to individuals who belong to either category, but would not require any changes to existing health care facilities.

For example, a transgender individual seeking bedding in a room that matches his or her gender identity would not be denied.

This language would give the department the tools it needs to ensure compliance among providers.

Adding a new rule is just another step in the progress being made towards protection of transgender individuals in society, said Laurie Shanderson, associate dean of the Stockton University School of Health Sciences. “In the past, language in health plan policy said transgenders would not be treated. There has been a lot of progress to eliminating that.”

The ACA currently protects the rights of individuals of all races, colors, national origins, disabilities and ages.

The proposed rule changes would also affect women, demanding equality in services and health care coverage, as well as ensuring proper communication and language services are provided for individuals with disabilities and limited English-language speakers.

The proposal has been posted on the HHS website for the duration of the public comment period, which ends Nov. 6.

This transgender thing is TOTALLY out of control. Amazing how the tiny special interest groups have successfully changed our culture in ways the vast majority are opposed. We seem to be living in a reverse-minority discrimination time.

this goes beyond accomodations for people who imagine that they are of a different sex. it also mandates language and cultural accomodations that may be very costly.

and if we are going to create a special ACA right and rule for people who imagine they are of a different gender, why not people who imagine that they are Napoleon or Lincoln?
